There is no judge or courtroom and the hearing typically lasts no more than 10 minutes.
Although all creditors have a right to attend the hearing, creditors regularly do not show up. If they do, creditors are usually interested in the condition of any collateral you might have such as a car, house, or boat, whether it is insured, and whether you intend to try to keep it or give it up.
The Bankruptcy Trustee is also present to ask whether you have any property of value to be sold for the creditors and to verify that all the information in your petition has been stated accurately and truthfully. It is extremely important to openly disclose all aspects of your financial situation when filing your bankruptcy petition.
